There have been a number of significant product liability cases in the US in recent months. Thomas E Riley from our New York office has prepared an article which was first published in the annual survey issue (51-2) of the Tort Trial & Insurance Practice Law Journal.
The article presents a summary of significant products liability cases from 1 October 2014 to 30 September 2015. It covers a range of developments concerning a variety of subjects, including the adoption of a new approach to strict products liability in Pennsylvania, application of the “stream-of-commerce” test for personal jurisdiction, federal preemption, and the admissibility of expert testimony to prove causation. It also discusses developments concerning the learned intermediary defense; class action standing requirements and settlements; and case management issues, including the use of Lone Pine orders.
