The article explores the approach the courts are taking when dealing with the service of a document on a state, and how this approach was shaped by the recent decisions of General Dynamics UK Ltd v The State of Libya and Qatar National Bank v Eritrea. The article also considers the cases Kuwait Airlines Corporation v Iraqi Airways and Certain Underwriters at Lloyd’s London v Syrian Arab Republic and others, whilst highlighting any changes in the court’s approach and recent case law that practitioners ought to be aware of.
